These Terms of Service and End User License Agreement ("Terms") are a legal agreement between you and Ubeni LLC ("Ubeni," "we," "us," or "our") governing your use of Futurely and related services.

1. Acceptance

By downloading, accessing, or using Futurely, you agree to these Terms, our Privacy Policy, and our Community Guidelines.

2. Eligibility and age requirements

You must be at least 13 years old to use Futurely. If you are under 18, you may only use Futurely with permission from a parent or legal guardian. Futurely is not intended for children under 13.

3. Account registration and security

You can create an account and sign in with Apple, Google, or an email address and password. Email/password accounts may require email verification before full access. You are responsible for maintaining account credentials, keeping account information accurate, and all activity under your account.

4. Subscription terms and complete paywall

Futurely is a subscription app and core functionality may be behind a complete paywall selected during onboarding. Subscriptions are offered under the "Futurely Pro" subscription group.

Available options may include:

$6.99 per month, with no free trial
$49.99 per year, with a 1-week free trial for eligible users

Payment is charged to your Apple ID/App Store account. If you start an eligible yearly free trial, the yearly subscription begins after the 1-week trial unless canceled before the trial ends. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. Your account may be charged for renewal within 24 hours before the end of the current period. You can manage and cancel subscriptions in Apple Account/App Store settings. Deleting the app does not cancel a subscription. Refunds are handled by Apple where applicable.

5. License grant

Subject to these Terms, Ubeni grants you a limited, non-exclusive, non-transferable, revocable license to use Futurely for personal, non-commercial use.

6. User content and rights you grant us

You retain ownership of your content, including the images you upload to vision boards and the text you write in readings, intentions, and comments. You grant Ubeni a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, display, and otherwise use your content as needed to operate and improve the Services.

7. Social and sharing features

Futurely includes social functionality such as friend connections (added by Friend ID, invite link, or QR code), favorite friends, shared tarot readings, group readings with comments, vision boards with comments and likes, vision board collaboration, and a public Explore feed with search.

If you add or accept another user as a friend, you understand that your profile details visible to friends — including your name, profile photo, chosen tarot deck, gender, and birth information — and related astrology profile details may be shared with that friend or used with that friend connection to provide compatibility, reading, relationship, and other social features. Friends may also see an online/recently active indicator unless you turn off Online Status in your settings. You are responsible for choosing who you connect with and should only add or accept friends if you are comfortable sharing this information with them.

Vision boards support multiple visibility levels: private, friends only, and public. If you set a vision board to public, its title, description, tags, and vision previews become visible to other Futurely users in Explore and to anyone with the link, and other users may like, favorite, or comment on it. You can choose whether your name and profile picture are displayed with a public board. Comments you post on other users' boards are visible to that board's owner and to anyone who can view the board. Do not post content you are not comfortable sharing publicly, and do not include another person's private information without a lawful basis.

If you invite friends to collaborate on a vision board, collaborators receive edit access and can add, change, or remove board content. You can remove collaborators at any time, and collaborators can leave a board. Edits by collaborators may trigger notifications to others on the board.

All user-generated content and interactions are subject to our Community Guidelines, which are incorporated into these Terms. We have zero tolerance for objectionable content and abusive users.

If you submit another person's birth information, you represent that you have their permission or another lawful basis to provide it. If you delete your account, shared content tied to your account, including your public vision boards and the comments you have posted on vision boards, is deleted as part of account deletion workflows, subject to legal and backup constraints.

8. Acceptable use and prohibited conduct

You agree not to use Futurely to:

Break laws, violate rights, or engage in fraud or deception.
Harass, abuse, threaten, or exploit others.
Promote violence, self-harm, sexual exploitation, or child safety violations.
Spam, impersonate others, invade privacy, or submit another person's birth information without appropriate permission or lawful basis.
Attempt unauthorized access, reverse engineer, or bypass security systems.
Use AI output as sole professional advice without proper human review.

9. AI disclaimer and no professional advice

AI output can be inaccurate, biased, incomplete, outdated, offensive, or unsuitable. Futurely does not provide medical, legal, financial, tax, mental health, safety, or emergency advice.

10. Moderation, reporting, and blocking

We may review, restrict, remove, or disable content/accounts to enforce these Terms and our Community Guidelines, including when content is flagged as sensitive or objectionable. We use automated moderation checks on user-generated text such as comments and reading questions, and we may suspend or terminate access for violations, abuse, legal compliance, or operational reasons.

Futurely provides in-app tools so you can report objectionable content or abusive users from friend profiles, vision boards, vision board comments, shared readings, group readings, and group reading comments, and so you can block users so their content is hidden from you and they are removed from your circle. You can manage blocked users under Settings → Account Settings → Blocked Users. We review credible reports of objectionable content and abusive users and act on them within 24 hours, which may include removing content and ejecting the responsible user.

11. Service availability and usage limits

Futurely may apply usage limits, quotas, rate limits, throttling, feature limits, or temporary access restrictions to protect service reliability, security, abuse prevention, and reasonable operating costs. These limits may vary by feature, account status, subscription status, device, region, operational conditions, or suspected misuse. We do not guarantee uninterrupted, unlimited, or error-free access to AI features or third-party services.

12. Intellectual property

Futurely, including software, branding, and related materials (excluding your content), is owned by Ubeni or its licensors and protected by law.

13. Third-party services

Futurely depends on third-party providers including Apple, Firebase/Google Cloud, and OpenAI. We are not responsible for services outside our control.

14. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UBENI AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, OR BUSINESS. OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE SERVICES IS LIMITED TO THE GREATER OF: (A) AMOUNTS YOU PAID FOR FUTURELY IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

16. Indemnification

You agree to indemnify and hold harmless Ubeni from claims, losses, liabilities, and expenses arising from your misuse of the Services, your content, or your violation of these Terms or applicable law.

17. Governing law

These Terms are governed by the laws of Illinois, United States, without regard to conflict-of-law principles.

18. Changes to terms

We may update these Terms from time to time. Updated versions become effective when posted with a revised effective date.
